THE FLOWER POD – Membership Terms & Conditions of Use

Introduction: These Terms and Conditions set out how you (the user) can use The Flower Pod Online Mentoring Programme. 

About and how to contact me: The Flower Pod is part of Kate Avery Flowers and The Little Flower School.

My core ethos for THE FLOWER POD ONLINE MENTORING PROGRAMME is to help and support florists wishing to grow a successful wedding flower business.

Programme Terms: Key Details: The terms cannot be varied and in purchasing the Programme you will be deemed to have accepted these terms. The terms and conditions set out below apply to the services offered by THE FLOWER POD ONLINE MENTORING PROGRAMME. Please read them carefully as they affect your rights and liabilities under law and set out the terms under which THE FLOWER POD ONLINE MENTORING PROGRAMME (“we”, “our” , “I” or “us”) provide services to you, as purchaser of the 12 week programme. These terms are subject to any rights you have under consumer law to which we are bound and which cannot be waived by contract.

Programme Outline: THE FLOWER POD ONLINE MENTORING PROGRAMME is a 12 week programme for flower business owners who want to learn how to grow successful wedding flower businesses. 

The aim of the group programme is to provide support and guidance on the strategies which flower business owners need to help them to grow and become profitable without burnout. The information and training provided is not tailored to any specific individual or business but includes information which has been tested and used across my wedding flower business of 19 years and the expertise of trusted outside individuals and their proven business growth strategies. The programme is aimed and designed for those who are at the beginning of growing their wedding florist business and fir the a few years in who are in need to a business boost. 

Programme Details

1: A mix of live weekly trainings and bonus pre-recorded training sessions make up the programme.  Trainings are either hosted by Kate, or by one of the Flower Pod external experts. Some sessions will have downloadable workbooks, and others will be reliant upon you taking notes.

2: Weekly live Zoom Q&A session 

3: A private Facebook Group

Weekly group training video drop: The training videos will either be led by Kate Avery or by one of the invited Flower Pod experts. For the most part the weekly trainings are live via Zoom. We also have pre-recorded bonus sessions. For the live sessions, you will be notified of the joining link in advance and a replay will be available to those who cannot attend in real time. The live sessions usually take place on a Thursday at 10.30am UK time. In rare cases this may change if a guest expert cannot do their alloted time, but I will give you as much warning as possible. I will aim to get you a course schedule at the start of the Programme. It is strongly advised that you block out a set time in your diary each week to watch the weekly video sessions. Think of it like a date with the hairdresser which you wouldn’t dream of cancelling! Live is always best if possible.

Weekly Q&A and support sessions: The weekly support session with Kate Avery will take place over Zoom for between 30 mins to 1 hour. The live sessions will take place every Tuesday morning at 10:30am UK time unless otherwise notified. Before each Q&A session you will have the opportunity to submit your weekly question via Wats App on 07799 766955. This question can be anything related to the wedding flower industry or a specific issue you are dealing with that week or a question about what we have covered that week in the training or during past weeks of the programme. The session is your time to pick Kate’s brain. Once again please do block this time slot out in your diary.

Private Facebook Group: You will have access to a private Facebook group to support you during the Programme. The aim of the group is to provide a safe and supportive community of like-minded floralpreneurs. Here you will find support from individuals who are all facing similar challenges within their businesses. 

Kate Avery will jump into the group regularly. Sometimes with planned posts and sometimes with impromptu. The group will be regularly monitored but there is no guarantee that posts will be responded to immediately. Please do not use messenger to contact Kate, but instead use Whats App 07799 766955 or email hello@thelittleflowerschool.co.uk. Kate will respond within 24 hours.

Behaviour and Etiquette: It is requested that at all times your behaviour towards others is polite and respectful. I will not be held responsible for the behaviour or actions of any other members. Should your behaviour be deemed offensive or inappropriate I reserve the right to remove you from the Programme with immediate effect.

Disclaimers: The aim of the Programme is to provide you and empower you with the tools, knowledge and understanding to attract the right clients for you and to grow and scale your wedding flower business so that you can create a business which feels right and is right for you. As a business owner your business is individual and personal to you. We all live in different areas of the country and our audiences are all different, and whilst the strategies and training which myself and others will provide are tried and tested, it is not intended that you will see instant results simply by watching or participating in a training session. My aim is to arm you with all the tools, training and strategy so that you can repeatedly tap into the knowledge and expertise provided to grow your business over time. I make no guarantees or claims as to the success of any member. What works for one member may not necessarily work in the same way for another. All information provided will be general information and guidance and will not be specifically tailored to your own business set up.  I am not responsible for any action or inaction which you take as a result of the information within the programme. I am not responsible for any loss of opportunity or any investments which you make. 

I ask that all members in the membership respect the rights of others in respect of their behaviour and privacy. I will not be responsible for the action of any members including for any disclosures made by any members based on information which has been shared within the programme.

Contact and Schedule: My intention is that the programme and all live sessions and training will run as per the initial set up. If for unforeseen circumstances a session should be cancelled it will be re-scheduled as soon as possible. 

If you have a technical query relating to accessing the Programme please email hello@thelittleflowerschool.co.uk, and I will aim to answer this email within 1 working day.

I am extremely passionate about supporting everyone on the Programme. You may see me post on social media outside of my core working hours, however some of these posts may be pre-scheduled and you may not receive a reply straight away, although I will do my best. As a general guide my working hours are 9 – 5, Monday to Friday.

Payment Terms: The cost of the Programme is set at the time you sign up. On signing up you will agree to one entire payment to cover the cost of the course.

Privacy and Confidentiality: I take protection of your privacy and personal data very seriously. Please rest assured that your personal data is protected. 

During the course of the Programme you may have access to confidential information including, in particular, following the personal affairs of others on the course. In accepting these terms, you agree that you will not use or disclose to any person, organisation or company, and shall use your best endeavours to prevent the publication of, any confidential information relating to any other member. What is brought to the group stays in the group and the group remains a safe and nurturing space.

You accept that any unauthorised disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the Programme. Should you decide to leave the Programme then you remain bound by the confidentiality and privacy obligations.

Refunds and Cancellation: It is my aim that you will be completely happy with the Programme and find support, friendship, encouragement and educational materials to help you grow your wedding flower business. 

In accordance with Distance Selling Regulations, you have the right to cancel and obtain a full refund within 14 days from the date of agreeing to sign up to the Programme. Refund requests should be made in writing to hello@thelittleflowerschool.co.uk and a full refund will be provided within 14 working days.

In the event that you have accessed one or more training sessions or that live sessions have already taken place within the first 14 days following your sign up, you are still entitled to request a refund but the value of the session(s) shall be deducted from the amount paid by you, along with any reasonable costs which have been borne by myself in respect of the administrative costs of commencing the programme. 

There is no obligation on myself to refund any amounts paid where cancellation requests are made following the 14-day cancellation period.

We reserve all rights to cancel the Programme for any reason without prior notice. In such circumstance a refund will be provided for the remainder of the programme as applicable. 

Upon cancellation of your membership to the Programme you will lose access to the Facebook group and any content with immediate effect.

Intellectual Property: During your 12 weeks you will be provided with course materials. At all times the intellectual property rights and copyrights connected with those materials remain with me. You have the right to use the materials as learning tools but you are not permitted to duplicate or provide copies to third parties. I retain and reserve all of my copyrights.

Complaints: If you have a complaint about the programme this should be made to made in writing to Kate Spicer at hello@thelittleflowerschool.co.uk 

Frequently Asked Questions: There will always be replays available for all Programme content

Additional support can be offered to each member in the form of 1:1 support or guidance. I am happy to support you as required, please contact me directly, additional charges will apply.

General
I intend to rely on the written terms set out in these terms and conditions for the services that I provide to you in delivery of the Programme. These written terms shall constitute the entire agreement between us.

I may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.

These Terms are governed by the laws of England & Wales. The Courts of England & Wales have exclusive jurisdiction over any matter and proceedings arising out of the Programme.
